Is anyone familiar with the background check system? Where does the FFL holder call to start the check? Who does the check?
Been a while since I purchased a gun, but seems like last time it only took a few minutes. Had a friend win a gun at a drawing and his check went the full 3 days with no return call. He gets the gun tomorrow supposedly. Why do some come back in minutes, while others take days, or no reply?

MT,

It is an 800 number in DC to the FBI. The FBI is checking into the background of the prospective buyer, looking for felony convictions or misdemeanor domestic violence, etc.

The FBI office will tell the FFL holder to then;
1) Proceed -Buyer is OK to receive the gun.
2) Delay -There is something in the buyer's history to raise an eyebrow, and a supervisor must be contacted.
3)Deny -Buyer gets his money back and no gun, and the FBI will take action further, if a felon has attempted to buy a firearm.

It depends on the buyer's background and who answers the phone at the FBI whether there is a delay and for how long. If there is no answer back on a "Delay" in 3 buisness days, then it is an automatic "Proceed". The 3 days does not include the day of the call or the day of the transfer, 3 days in between and you're good to go .

I've only had trouble on weekends. A disgtuntled FBI twit, that is at the bottom of the seniority list, I presume. I got a deal on a Winchester M70 that I bought on a Sunday afternoon and got the delay treatment, the sales kid wasn't any better. He told me that I would have to come beck in three days.
On Monday I went back and an older fella called in to NICS and I walked out with the shooter about ten mins later.

It has nothing to do with who answers the phone in VA.

The dealer calls the 800#, gives his FFL# and then his coded password. The customer can speed things up possibly by listing their SS# on the Form 4473. Any clue as too how many Fred Smiths live in the USA? 3 business days and weekends do not count. Even if delay is the answer at the first contact with the FBI they will put you through to another person that will do a follow up on the delay right then and there. If that second check can't come up with an answer, you will have to either wait for a response or pick up the firerarm after the end of 3 business days if there is no response in the affirmative. A denial is all anybody should get their panties in a knot over. Of course they could save themselves the headache by having an AK CCW Permit.

Just as a side note, if you haven't gotten a CCW permit yet, it will not make you exempt any longer. Also, if you have to renew your CCW, the new one will not be NICS exempt. They (the state) say it is due to lack of cooperation from the fed, but that is not true. Also, these days, if you are a resident alien, you can expect a delay.

My permit says "NICS Exempt" right on it, but when I bought my last gun the seller called it in to NICS regardless.

No, you can get a CCW, but it will no longer make you exempt from the NICS background check. Also if you renew the one you have.

I recently heard the same story...that the feds are the ones who are no longer allowing the state to issue background check exemptions with the conceal carry permit. Have you heard differently? Can you share what you've heard? My permit comes up for renewal in March next year, and I was hoping that we can collectively do something to change this...especially if it's a state level hang-up.

If you showed your AK NICS Exempt CCW, the seller should not have done the background check. There's a lot of misunderstandings and paranoia out there. Wasn't Wal-Mart by any chance?

We did some googling in regards to this and apparently several states, including Georgia, are still allowing NICS Exemptions for their CCWs, and it is okay with the Feds. Alaska is saying it is the Feds who are denying the exempt status. So, you have to draw your own conclusions on who is doing us wrong.

Not having a AK CCW Permit for a couple of years, is the State of Alaska still doing fingerprints for the CCW? If not that may be the reason they are not being accepted by the Feds. When the CCW permit first became available in Alaska you had to have your fingerprints taken. I don't know what changed from the first permits to the new NICS Exempt permits. Has anybody had both of these permits? What was the differences in obtaining the NICS Exempt Permit and the NICS Non-Exempt Permit? If fingerprints are no longer being taken for the State CCW Permit that could be the reason the Feds will not except them.

According to the guy at the store where this transaction will take place, there has been no call back. Just silence.
Sounds like the FBI uses this law to delay sales to anyone with any kind of record, even convictions that don't disqualify one from legally purchasing a gun.

Actually, I don't think the feds are using the delay as an anti-gun tactic. There are several circumstances, such as a sale to a resident alien that almost always cause a delay. It just means that for some reason, they want to do further investigation. I don't think a misdemeanor record is a cause for them to delay. Sometimes they call back and sometimes they don't, which is why they give a three day delay. Not much rhyme or reason for it. Some days there seem to be more delays then others. Obviously three {business} days of silence are better then a quick call back for a denial. We certainly have it better then residents of other states, such as California or Hawaii. But we have to be vigilent and do what we can to avoid any further suppresion. I am pretty sure it is Murkowskiland that is messing us the CCW exemption situation. Now I bet I get some responses.

I have purchased 4-5 long guns over the past 18 months or so and have never had to wait longer than about 10 mins or so before walking out the door with guns in hand.

Dunno if it means much, but the two times I recall being NICS checked, they got the word to delay. Both times, the guy at the gun shop (these were in two different cities) told me they usually get a proceed or deny callback within an hour or so.

I don't have the world's most common name, but it isn't exactly Herkimer Z. Hassenfeffer, either. And no record at all that I'm aware of.

Both times, the shop got the go-ahead call in roughly the time it took me to drive for a cup of coffee and some groceries.

My experience working up here in Alaska is that it is a crapshoot, but if you have purchased several guns and got proceeded right away, you probably won't have a problem in the future. If you are delayed once, you probably will get delayed in the future too. No exact explanation for it. Most people get proceeded, some don't. Usually there is silence for the required three business days and then you come get your gun. Sometimes they call back. If you do get proceeded, it is almost instantaneous, maybe a 15 second pause. That's my experience in the store.

With the way those upstanding, cat-stomping professionals at BATFEces operate, the paranoia is well placed.

I get a couple of delays on me inspite doing a couple of transfers or more a year. The way it's been explained to me is that a delay is due to infomation that has to be accessed by a higher level fedtoady that the phone monkey has no clearance for.
Mine I suspect is due to past military security clearances and current status as a C&R FFL holder. My delays haven't exceeded the length of time it takes me to scratch out the 4473.
